Welcome to After School Beacon – a shared marketplace that connects parents/guardians (“you”, “your”) with independent third‑party providers (“Providers”, “Vendors”) offering after-school programs, summer camps, enrichment activities, and related services for children.
These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and any related services (collectively, the “Platform”). By creating an account, placing an order, or otherwise using the Platform, you agree to be bound by these Terms.
Important: Your electronic consent (checking a box or clicking “I Agree”) is the legal equivalent of your handwritten signature under the federal E‑SIGN Act and California law.
1. Marketplace Role
After School Beacon operates a shared marketplace that facilitates discovery, ordering, payment processing, and related administrative services between parents and independent Providers. We are not the provider of any program listed on the Platform unless explicitly stated. We do not employ, control, or supervise any Provider’s instructors, staff, facilities, or operations. Each Provider is solely responsible for its programs, including safety, staffing, curriculum, compliance with applicable laws, and adherence to its own cancellation and refund policies.
2. Account Creation & Consent
- You must be at least 18 years old and the parent or legal guardian of any child you enroll.
- To create an account, you must check a box affirming: “I have read, understand, and agree to the Terms of Service and the Privacy Policy.”
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Orders, Processing & Enrollment Confirmation
3.1 Placing an Order
When you select specific classes (date/time offerings) within published programs and proceed to checkout, you are placing an order with After School Beacon. The total displayed at checkout is an estimated amount based on the classes you have selected.
3.2 Order Processing & Confirmation
After you place your order, we will process it. Processing includes verifying availability of each class with the Provider and charging your payment method. Being charged means your enrollment is confirmed for the classes that are successfully processed. You will receive a confirmation email summarizing the confirmed enrollments and the actual amount paid.
- If a class is full, unavailable, or cannot be confirmed for any reason, we will not charge you for that class. The final amount you are charged may therefore be lower than the estimated total shown at checkout.
- Prices for each class are preserved at the amount shown in your order; your order total will never exceed the estimate due to price changes.
- Classes that are not confirmed will not result in enrollment, and you will be notified.
3.3 Waitlists
If a program is full, you may join a waitlist. If a spot becomes available, the Provider may automatically enroll the next eligible student and you will be notified. You may be charged at that time according to the Provider’s policy.
4. Payment, Fees & Billing
4.1 Payment Processing
All payments are processed through a third‑party payment processor. The charge on your statement will appear as “AFTER SCHOOL BEACON” or a similar identifier.
4.2 Final Charge & Adjustments
The final amount charged will be the amount communicated in your order confirmation. If the final amount differs from the estimate (as described in Section 3.2), we will show the adjusted amount before charging, except when it is lower due to unconfirmed classes—in that case, you will be charged only for the confirmed classes, and the reduction will be reflected in your confirmation.
4.3 Recurring Payments & Auto-Enrollment
Some Providers offer programs with recurring or automatically scheduled payments (“Auto-Enrolled Programs”). Each Provider sets its own terms for Auto-Enrolled Programs, including price, billing frequency, and cancellation rules. These terms are displayed on the program listing page before you enroll. By enrolling in an Auto-Enrolled Program, you: Authorize us to charge your payment method on the schedule set by the Provider. Acknowledge that future charges may occur without additional notice, unless you cancel your student program enrollment. Cancellation of Auto-Enrolled Program stops future charges but does not guarantee a refund for payments already processed. Refund eligibility is governed by the Provider’s cancellation policy.
5. Cancellation & Refunds
Each Provider sets its own cancellation and refund policy, which is displayed on the program listing page before you place your order. By completing an order, you agree to that Provider’s cancellation policy. Refunds for provider-initiated, dissatisfaction, no‑show, or voluntary withdrawal are at the sole discretion of the Provider, subject to its published policy.
6. Data Sharing with Providers
To facilitate enrollment, we share certain information about you and your child with the Provider(s) you have booked, including:
- Parent/guardian name, email, phone number.
- Child’s name, age/grade, school (if provided).
- Any medical or allergy information you provide on the registration form.
Providers are required to use this information only to administer the program you have booked and may not sell or share it with third parties except as required by law.
7. Your Responsibilities & Child’s Conduct
- You must provide accurate, up‑to‑date health, allergy, medication, and emergency contact information.
- You must ensure your child meets the age/grade and skill requirements of the program.
- You are responsible for timely drop‑off and pick‑up and for adhering to the rules of the Provider and the host facility.
- Your child must behave respectfully toward instructors, staff, and other children. Persistent or serious behavioral issues may result in suspension or dismissal from the program without refund.
8. Late Pick‑Up & Authorized Release
- Your child will only be released to individuals you have designated as authorized pick‑ups on the registration form, who must present valid photo identification.
- If your child is not picked up by the scheduled end time, the Provider may assess a late pick‑up fee.
- Repeated late pick‑ups may result in termination of enrollment without refund.
9. Termination & Suspension
We may suspend or terminate your account and access to the Platform if you:
- Provide false or misleading information.
- Violate these Terms or the rights of any Provider or other user.
Upon termination, you remain liable for any unpaid fees accrued before the effective date of termination.
10. Disclaimer of Warranties & Limitation of Liability
10.1 Platform “As Is”
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Platform will be uninterrupted, error‑free, or free of viruses or other harmful components.
10.2 No Liability for Providers
To the maximum extent permitted by law, AFTER SCHOOL BEACON is not liable for any indirect, incidental, special, or consequential damages arising from your child’s participation in any Provider’s program. We are not responsible for the acts, omissions, negligence, or misconduct of any Provider, its employees, instructors, or agents.
10.3 Direct Disputes with Providers
Any dispute between you and a Provider (e.g., personal injury, quality of services, refund disputes) shall be resolved directly between you and that Provider. We may attempt to facilitate a resolution but have no obligation to do so and are not liable for the outcome.
10.4 Indemnification
You agree to indemnify and hold harmless AFTER SCHOOL BEACON, its employees, agents, and representatives from any claims, damages, or liabilities arising from:
- Your child’s enrollment in any Provider’s program.
- Your breach of these Terms.
- Your dispute with any Provider.
11. Electronic Signatures & Consents
By checking the “I Agree” checkbox or clicking a similar button during account creation or checkout, you are providing an electronic signature that is legally binding and equivalent to your handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E‑SIGN Act) and California Civil Code § 1633.7.
We will maintain an audit trail of your consent (including timestamp, IP address, and the version of these Terms) for evidentiary purposes.
12. Dispute Resolution & Arbitration
12.1 Informal Resolution
You agree to first contact us at contact@afterschoolbeacon.com to resolve any dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue arbitration as set forth below.
12.2 Binding Arbitration
Any dispute arising out of or relating to these Terms or your use of the Platform (excluding disputes between you and a Provider, which shall be resolved directly between those parties) shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Travis County, Texas. Judgment on the award may be entered in any court having jurisdiction.
12.3 Class Action Waiver
You agree to resolve any dispute on an individual basis and waive the right to bring or participate in any class, consolidated, or representative action.
13. Governing Law
These Terms are governed by the laws of the State of Texas and the federal Electronic Signatures in Global and National Commerce Act (E‑SIGN Act), 15 U.S.C. § 7001 et seq., without regard to conflict of law principles.
14. Modifications to Terms
We may modify these Terms at any time by posting a revised version on the Platform. If we make material changes, we will notify you by email or through your account. Your continued use of the Platform after the effective date constitutes your acceptance of the modified Terms.
15. Miscellaneous
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy and any specific terms displayed on a program listing, constitute the entire agreement between you and AFTER SCHOOL BEACON regarding your use of the Platform.
